IP Patentability & Protection: 6:45 pm -7:15 pm

This workshop will cover different types of Intellectual Property and how to protect each one. We will discuss why each type of protection might be beneficial to companies and address patentability of both software-based and hardware-based inventions as well as products.

Presenter: Barry R. Lewin, Esq, Gottlieb, Rackman & Reisman, P.C.

Barry R. Lewin is a partner and a patent attorney with Gottlieb, Rackman & Reisman, P.C. He focuses his practice on patent prosecution in the mechanical and electronic arts including software-based and hardware-based inventions. Prior to earning his law degree, Mr. Lewin was a Director at Lucent Technologies, Telcordia Technologies, and SAIC, where he led teams in intellectual property and new product development. Mr. Lewin holds a Doctor of Law degree from Rutgers School of Law, a Masters degree in Mechanical Engineering from MIT, and a Bachelors degree in Mechanical Engineering from Tufts University.

What is Your IP Worth? Licensing. vs Selling: 7:45 - 9:15

How do you know how much your intellectual property is worth? Should you license it or sell? If you are selling it, what is a good deal?

Being able to value your IP allows you to determine an exit strategy, provides leverage in investor negotiations, in the event of an acquisition or when one of the equity stakeholders leaves.

In this Workshop we will cover:

1. What is IP and how is it accounted for on the Balance Sheet?

2. When is it important to know what your Intangible Assets are worth?

3. Three valuation approaches:

A. The Cost Approach - based on the direct (e.g. equipment) and indirect (e.g. labor) costs incurred in creating an asset

B. The Market Approach - based on comparables

C. The Income Approach - based on the income an asset is expected to generate

We will discuss circumstances which will warrant using one approach over another, how each approach works and do a case study for each.

Finally, we will cover under which circumstances one can capitalize software development costs as an asset on the balance sheet.

Victoria Yampolsky, CFA, is the President of the Startup Station and Compass NYC, financial & strategy consultancies that focus on formulating and implementing monetization strategies. She is also an advisor to Mobilosophy, Divvy Tools, and Plan to Start, as well as founder of several ventures in media & entertainment. Previously, Victoria worked in Deutsche Bank Research and did IT consulting for CapGemini's Financial Services Division.
