Most websites incorporate content that others have created - sometimes with permission, sometimes without it. Website owners and operators post photographs, screen grabs or GIFs from other sources, incorporate content from social media platforms like Facebook, Twitter and Instagram, embed videos from video-sharing sites and reappropriate content in many other ways. Users also post their own text, images, videos and other material on the sites - which may also use third-party content. This panel will discuss:

Potential areas of legal exposure from using third-party content, based on copyright, trademark, privacy/publicity, libel and other areas of law, that websites should know about
Possible legal defenses that allow sites to use third-party content in many circumstances, including fair use, public domain and the legal protections offered by the Digital Millennium Copyright Act and the Communications Decency Act
Best practices for steering clear of liability and taking advantage of these legal protections
As with all events in NYTECH's legal track, the goal of this presentation is to assist non-lawyers in recognizing and understanding some of the important legal issues confronting their businesses. Lauren Fisher, General Counsel, Vox Media

Lauren Fisher is VP & General Counsel for Vox Media, Inc., which publishes premium media brands including The Verge, SB Nation, and Eater on Vox's proprietary publishing platform and modern media stack. Lauren is responsible for leading Vox Media's legal team, where she routinely deals with the issues of both a content and technology creator/publisher as well as use of third party content and technology. When she is not wearing her legal hat, Lauren also manages strategic business development. Before joining Vox Media, Lauren worked as Assistant General Counsel for AOL for almost 7 years, leading a team that managed wide-ranging intellectual property matters, complex technology deals. and various aspects of new media law. During her tenure at AOL, Lauren spearheaded the implementation of a comprehensive rights and clearances program, and the delicate legal navigation of AOL's foray into the frontier known as the blogosphere. Prior to joining AOL, Lauren worked in-house at The Vanguard Group as Associate Counsel for Intellectual Property where she set up Vanguard's IP program. Before moving in-house, Lauren practiced law in the field of Intellectual Property with Akin, Gump, Strauss, Hauer & Feld, L.L.P.

Jeff Grossman, Assistant General Counsel, AOL Inc.

Jeff Grossman is Assistant General Counsel for AOL Inc., where he advises The Huffington Post, TechCrunch, Stylelist, Mapquest and AOL's other properties on copyright and media law issues. Jeff's previous experience includes serving as Senior Counsel for Cablevision, working with its newspaper and television news businesses, and practicing as an associate in the New York office of Hogan Lovells, where he focused on litigation and advising media clients. Jeff earned his J.D. at NYU School of Law and a B.A. in Political Science from Binghamton University.

Rebecca Sanhueza, Vice President and Deputy General Counsel, Time Inc.

Rebecca Sanhueza is Vice President and Deputy General Counsel of Time Inc. where she oversees editorial and business side legal issues for the company's brand divisions (print and digital). Rebecca also has responsibility for the TV, film and video transactional and production work across Time Inc. Prior to joining Time Inc., Rebecca was Associate General Counsel at Gruner + Jahr USA; and, prior to that, she was a litigation associate at Gibson, Dunn & Crutcher LLP. Rebecca has a J.D. from Columbia law school and a B.A from the University of Michigan, Ann Arbor.

Jim Rosenfeld, Partner, Davis Wright Tremaine LLP (Moderator)

Jim Rosenfeld (moderator) is a partner at Davis Wright Tremaine LLP who litigates and counsels on media, intellectual property, and Internet law - including copyright, trademark, right of publicity, invasion of privacy, defamation, and commercial matters. Jim represents a wide array of Internet content and service providers, including the operators of blogs and other online publications; the licensors of images, footage and music; and the publishers of news, health, education, and travel websites. He advises clients on issues unique to content providers on the Internet and other new platforms, including the Digital Millennium Copyright Act and Communications Decency Act legal immunities for user-generated content, liability arising from linking, framing and aggregation of content, and issues relating to online advertising, social media and piracy.
